EXAMPLE OF DUTIES
Auto Industry DivisionThe Auto Industry Division is responsible for regulating the Motor Vehicle and Powersports Industry with balanced emphasis on Education, Compliance, and Enforcement of applicable laws and regulations. The Division regulates with fundamental fairness by ensuring that three key components are the primary focus: Educate and protect consumers; To treat applicants and licensees fairly, professionally, courteously, and efficiently; To foster an honest and healthy industry within the State of Colorado and to ensure consumer confidence for the manufacture, distribution and sale of all vehicles within the Division's jurisdiction. The unit is charged with ensuring that all licensees comply with Title 44, Article 20, parts 1 & 4 of the Colorado Revised Statutes and the related promulgated rules of the Colorado Motor Vehicle Dealer Board in addition to various federal laws and regulations. This is accomplished by the formulation of effective and efficient licensing procedures, quality background investigations of licensees and/or licensee applicants, and complete and thorough enforcement investigations. When appropriate, this unit can issue licenses, refer licensing decisions to the Motor Vehicle Dealer Board, close investigations or refer investigative results to the Board for administrative decisions and/or the local District Attorney for criminal filings.Job Duties: This position is a remote position of the Auto Industry Division and is responsible for the enforcement of administrative statutes and regulations pertaining to the Auto Industry. This position conducts background investigations on applicants to ensure fitness of licensing, financial and criminal character or background. This position is responsible for gathering facts, obtaining and analyzing financial documentation, business documentation and interviewing applicants. At the conclusion of the investigation, the Compliance Investigator prepares reports detailing the facts gathered during the investigation, and makes a recommendation as to the disposition of the investigative case. They may also prepare Affidavits of Probable Cause for presentation to the Motor Vehicle Dealer Board and testify in Administrative Court proceedings. Additionally, a Compliance Investigator provides education regarding laws and regulations to the licensees in order to facilitate the licensee's compliance with the laws governing their profession.Regulatory Education and EnforcementCompliance investigator plans and conducts investigations involving motor vehicle and/or powersport manufacturers, motor vehicle and/or powersport distributors, motor vehicle and/or powersports dealers, motor vehicle and powersports salespersons, wholesalers and business disposer licenses.Investigations include all alleged violations of local, state and federal statutes, rules and regulations. Compliance investigator applies investigative techniques used to obtain evidence, documents, financial records, statements, etc. and analyzing the documentation to determine the plan for conducting the investigation into the licensing, financial and criminal character or record the applicant. Report WritingCompliance investigator prepares comprehensive detailed investigative reports.Reports address the facts of the case (who, what, where, why and how).Reports also include a financial analysis, witness statements, interviews, and witness lists/contacts.Compliance investigator prepares Affidavits of Probable Cause to be presented to the Motor Vehicle Dealer Board detailing the alleged violations.ProsecutionPosition prepares case files, creates exhibits, and testifies in administrative proceedings before the Motor Vehicle Dealer Board as well as before Administrative Hearing Officers. Position must understand the myriad of applicable laws and regulations in order to effectively regulate the industry and effectuate the mission of the Auto Industry Division.Interact with the Attorney General's Office to prepare testimonial evidence, and provide documentary evidence and exhibits, for use in Administrative Hearings.Education and TrainingCompliance investigator provides training to the regulated community, other governmental agencies, and County Clerks.Additionally, the compliance investigator provides information to the general public on the regulations and laws governing the motor vehicle and powersports industry.
